Legal Aid Funding

Legal aid can help meet the costs of legal advice, family mediation and representation in a court, arbitration or tribunal.

Our Legal Aid Funding promotes fair legal proceedings and helps to ensure access to justice for economically disadvantaged individuals accused of serious, complex criminal offences and facing the likelihood of detainment, and for youths charged under the Family Law wherever they live in.

Our Legal Aid Funding Program also helps ensure that the accused is able to meet their criminal legal aid responsibilities in legal prosecutions, such as forensic and criminal law, civil, and asylum and immigration cases, as well as its responsibilities for immigration and refugee legal aid and the management of Court-Ordered Counsel in Civil Prosecutions.

You’ll usually need to show that:

  • the problem is serious
  • your case is qualified for legal aid
  • you can’t afford to pay for legal costs

You are eligible to apply for legal aid entitlement if:

  • you need family mediation
  • you’re being discriminated against
  • you’re at risk of losing your home or homelessness
  • you’ve been accused of a crime, face prison or incarceration
  • you’re adding legal arguments or bringing a case under the Human Rights Act
  • you or your family are at grave risk of abuse or serious threats of assault, such as domestic violence or forced marriage
